Fieldstream LLC

Terms of Use

Effective February 23, 2026  ·  Last updated September 16, 2026

01

Introduction

Welcome to Allout ("App"), a mobile application brand operated by Fieldstream LLC, a Wyoming limited liability company ("Fieldstream," "we," "us," or "our"). Allout is a trade name and product of Fieldstream LLC. These Terms of Use ("Terms") govern your access to and use of the App, including features such as posts, reels, direct messaging, marketplace listings, saved spots and maps, hunt and catch logging, hunting and fishing forecasts and scores, field tools, and artificial intelligence features (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

02

Eligibility (18+)

You must be at least eighteen (18) years old to use the Service. By using the Service, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms. We may request age verification and may suspend or terminate accounts if we reasonably believe a user is under 18.

03

Accounts and Security

You agree to provide accurate, complete, and current information and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity on your account. You must notify us promptly of any unauthorized use or security breach.

04

User Content and License

"User Content" includes any photos, videos, text, comments, listings, messages, and other content you submit or display through the Service.

You retain ownership of your User Content, but you grant Fieldstream a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting), distribute, publicly perform, publicly display, and create derivative works of your User Content solely to operate, develop, provide, promote, and improve the Service.

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party rights.

05

Acceptable Use and Zero-Tolerance Policy

Zero Tolerance: Allout has a zero-tolerance policy for objectionable content and abusive behavior. Content or conduct that is illegal, threatening, harassing, hateful, sexually explicit, or otherwise harmful will result in immediate removal and may result in permanent account termination without notice.

You agree not to:

  • Use the Service for any illegal purpose or in violation of any law
  • Post or transmit content that is unlawful, threatening, harassing, defamatory, obscene, hateful, or otherwise objectionable
  • Bully, intimidate, harass, or abuse any other user
  • Post content that exploits, sexualizes, or endangers minors in any way
  • Impersonate others, misrepresent affiliation, or provide false information
  • Upload malware or attempt to interfere with or disrupt the Service
  • Scrape, reverse engineer, or attempt to access non-public areas of the Service
  • Use the Service to facilitate fraud, scams, or deceptive transactions
  • Spam or send unsolicited commercial communications to other users
  • Post content that incites violence, discrimination, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

We may remove content, restrict features, or suspend/terminate accounts at any time for violations, suspected violations, or to protect the Service and users.

Content Moderation

Fieldstream reserves the right, but does not assume the obligation, to monitor, review, screen, remove, edit, or disable access to any User Content or account at any time and for any reason in its sole discretion. Fieldstream has no duty to monitor the Service and disclaims any responsibility for failing to monitor or remove content.

Reporting Objectionable Content

Users can report objectionable content or abusive behavior directly within the app using the built-in report feature available on posts, reels, profiles, listings, and messages. All reports are reviewed by Fieldstream and may result in content removal or account action. To report content outside the app, contact Support@alloutdoors.co.

Blocking Abusive Users

Users can block any other user at any time using the block feature available on user profiles. Blocking a user immediately removes their content from your feed and prevents further interaction. When a user is blocked, Fieldstream may also receive a notification of the action to assist in safety monitoring.

06

Intellectual Property

The Service, including its design, features, and original content provided by Fieldstream (excluding User Content), is owned by Fieldstream and its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

07

DMCA and Copyright Policy

If you believe that content on the Service infringes your copyright, you may submit a written notification including: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement that you have a good faith belief that use of the material is not authorized; (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

Notices may be sent to Support@alloutdoors.co. Fieldstream may remove allegedly infringing content and terminate repeat infringers in appropriate circumstances.

08

Third-Party Services and Links

The Service may contain links to or integrations with third-party sites and services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

Data Sources

The Service incorporates data from third parties, including weather and marine forecast data, mapping and satellite imagery, nautical chart and bathymetry data, and publicly published wildlife agency reports and survey data. That data belongs to its respective providers and is used under their terms and licences. It is provided to you for personal, non-commercial use within the Service; you may not scrape, bulk export, resell, or redistribute it.

Sources include:

  • Weather and marine forecast data by Open-Meteo.com, licensed under CC BY 4.0
  • Maps and satellite imagery by Mapbox and OpenStreetMap contributors
  • Nautical chart, bathymetry, and tidal data from the U.S. National Oceanic and Atmospheric Administration (NOAA)
  • Wildlife survey and harvest reports published by state and federal wildlife agencies, used as convenience summaries of those agencies’ own published releases
09

Marketplace Transactions

Neutral Venue

Fieldstream provides a platform for users to list, discover, and communicate about items. We do not own, inspect, verify, store, ship, or guarantee listings or users.

No Payments / No Shipping

Fieldstream does not process payments, escrow funds, arrange shipping, or resolve payment disputes. Any transaction is solely between users.

User Responsibility

You are solely responsible for complying with all applicable laws (including any age restrictions, licensing, transfer requirements, and local/state/federal regulations) for any item you list, sell, buy, or trade.

Prohibited Items

You may not list illegal, counterfeit, stolen, or otherwise restricted items. We may remove listings and take enforcement action at our sole discretion.

Use caution when meeting in person and when exchanging goods. To the maximum extent permitted by law, you agree to release and hold harmless Fieldstream from claims arising out of marketplace interactions.

Firearm & Regulated Item Compliance

If you list, purchase, sell, trade, or otherwise interact with firearms, firearm components, ammunition, or any regulated items through the Service, you represent and warrant that you will comply with all applicable federal, state, and local laws, including but not limited to age restrictions, licensing requirements, transfer requirements, background check requirements, shipping restrictions, and prohibited person restrictions. Fieldstream does not verify licenses, eligibility, or legality of any transaction. Users are solely responsible for lawful transfers.

10

Subscriptions and Billing

Paid Access

Access to Allout requires a paid subscription ("Allout Pro"), except where Fieldstream grants access by other means. Current plans, prices, and billing periods are shown in the App before you purchase.

Billing Through Apple

Subscriptions are sold and processed by Apple through your Apple Account, not by Fieldstream. Payment is charged to your Apple Account at confirmation of purchase.

Automatic Renewal

Subscriptions renew automatically unless canceled at least twenty-four (24) hours before the end of the current period. Your Apple Account is charged for renewal within twenty-four (24) hours prior to the end of the current period at the then-current price. You can manage or cancel your subscription at any time in your Apple Account settings. Deleting the App does not cancel a subscription.

Introductory Offers and Free Trials

Where an introductory offer or free trial is available, eligibility is determined by Apple. Apple generally allows one introductory offer per subscription group per customer, so you may not be eligible even where an offer is displayed. Unless canceled at least twenty-four (24) hours before it ends, a free trial converts automatically into a paid subscription at the price shown at purchase. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial period.

Lifetime and Promotional Access

Fieldstream may make lifetime or promotional access available through Apple offer codes or by direct grant. Promotional access is personal to you, non-transferable, has no cash value, and may be subject to limits or expiry. "Lifetime" means for the operating lifetime of the Service and does not create any obligation to operate the Service for any period.

Refunds

Because Apple processes payment, refunds are handled by Apple under its policies. Fieldstream cannot issue, guarantee, or compel refunds for purchases made through the App Store. Except where required by law, payments are otherwise non-refundable, and we do not provide refunds or credits for partial periods, unused features, or periods during which you did not use the Service.

Changes to Plans and Pricing

We may change plans, features, and pricing. Price changes apply to renewals only and take effect in line with Apple's requirements, which may include notice to you and, in some cases, your consent before the next renewal.

11

Hunting, Fishing, and Regulatory Compliance

Allout is an informational tool. It is not a legal authority on hunting or fishing regulations, and nothing in the Service is legal advice. You are solely responsible for knowing and following every law and regulation that applies to you, and for confirming the rules with the responsible state, federal, tribal, provincial, or local authority before you hunt or fish.

Shooting Light, Seasons, and Legal Hours

The Service may display shooting light windows, sunrise and sunset times, season dates, and similar information. These are estimates generated from general rules, third-party astronomical and weather data, and information you enter yourself. They are provided for planning convenience only. They may be inaccurate, incomplete, out of date, or simply wrong for your location, your species, your license class, your weapon, the specific parcel you are on, or the current season.

Regulations vary by state, county, wildlife management unit, property, season, species, and method of take, and they change. Fieldstream does not track, verify, or warrant the regulations applicable to you. Do not rely on the Service to determine whether it is legal to take an animal or fish at a given time or place. Verify with your governing wildlife agency.

Licensing and Permission

You are responsible for holding all required licenses, tags, stamps, permits, and endorsements, and for having lawful permission to access and hunt or fish any land or water. The Service does not determine property boundaries or verify access rights, and public land, boundary, and habitat layers are approximate and may be out of date.

Your Responsibility

To the maximum extent permitted by law, you assume all risk and responsibility for your compliance with law, and you agree that Fieldstream is not liable for any citation, fine, penalty, forfeiture, license suspension, prosecution, or other loss arising from your use of, or reliance on, regulatory information displayed in the Service.

12

Forecasts, Scores, and Conditions Information

The Service produces hunting and fishing forecasts, numeric scores, ratings, condition readings, wind and light calculations, migration and survey summaries, and related predictions (collectively, "Forecast Information").

Predictions, Not Promises

Forecast Information is an estimate of probability generated by models from weather data, astronomical data, third-party datasets, and information you provide. It is not a guarantee, a representation of fact, or a promise of any outcome. Game and fish behavior is affected by many factors the Service does not model and cannot observe. A high score does not mean you will see or take anything, and a low score does not mean you will not.

Accuracy and Model Quality

Model quality varies by species and location, and some models are early or unvalidated. Where the Service indicates that a model is early, unvalidated, or based on limited data, you should weight it accordingly. We may change, re-tune, or withdraw models at any time, and scores for the same conditions may change as a result.

Third-Party and Agency Data

Forecast Information incorporates third-party data, including weather and marine data and publicly published wildlife agency survey and report data. Fieldstream does not control, verify, or warrant that data, and it may be delayed, revised, or withdrawn by its source. Agency summaries in the Service are convenience summaries only; the publishing agency's own release is the authoritative version.

No Reliance

To the maximum extent permitted by law, you agree not to rely on Forecast Information for any legal, financial, or safety decision, and that Fieldstream is not liable for any loss, expense, wasted trip, missed opportunity, or other damage arising from Forecast Information or from your reliance on it.

13

Maps, Navigation, Recovery Tools, and Field Safety

Allout is not a safety device, a navigation system, or an emergency service. Do not rely on it to keep you safe, to find your way, or to summon help. Carry an independent means of navigation and communication whenever you go into the field.

Maps and Measurements

Maps, satellite and chart imagery, bathymetry, public land boundaries, offline map data, distances, bearings, and area measurements are approximate and provided for general reference only. They are not survey-grade and must not be used for navigation, boundary determination, or any purpose requiring precision. Boundary data in particular may be out of date or wrong, and does not establish a right of access.

Recovery and Tracking Tools

Tools that record a hit site, a bearing, or a breadcrumb track depend on your device's satellite positioning, battery, storage, and sensors. Positioning accuracy degrades under canopy, in terrain, in poor weather, and offshore, and may be unavailable entirely. These tools may fail, lose data, or report an inaccurate position. They are an aid to recovery, not a substitute for careful shot placement, field craft, and your own judgment.

Battery and Device

Features that keep the screen awake or use positioning continuously will consume battery significantly faster, and may do so at the moment you most need your phone. Managing your device's power and condition in the field is your responsibility.

Assumption of Risk

Hunting, fishing, boating, and travel in the outdoors are inherently dangerous activities that can result in serious injury or death. You participate at your own risk. To the maximum extent permitted by law, you assume all risk arising from those activities and from your use of the Service in connection with them, and you release Fieldstream from any claim arising out of them.

14

AI Features

The Service includes artificial intelligence features, including an assistant, generated summaries, and automated suggestions ("AI Features"). AI Features are processed using third-party AI providers. See our Privacy Policy for how that information is handled.

Output May Be Wrong

AI output is generated automatically and may be inaccurate, incomplete, outdated, or entirely fabricated, including where it is stated confidently or cites a source. AI output is not professional, legal, regulatory, veterinary, medical, or safety advice. You must independently verify anything you intend to rely on, and the regulatory and safety provisions of these Terms apply to AI output in full.

Acceptable Use

You may not use AI Features to generate unlawful, harmful, infringing, deceptive, or otherwise objectionable content, to attempt to extract underlying prompts or models, or in any manner inconsistent with these Terms. Do not submit sensitive personal information, confidential information, or information you do not have the right to share.

Availability

AI Features depend on third-party services and may be changed, limited, interrupted, or discontinued at any time without notice, including as part of a paid subscription.

15

User Communications

The Service may enable direct messaging and other communications between users. Fieldstream does not control, endorse, monitor, or assume responsibility for user communications. You acknowledge that you interact with other users at your own risk. Fieldstream is not responsible or liable for any statements, representations, harassment, threats, fraud, or other conduct occurring through user communications.

16

Termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, for any reason, including suspected fraud or violations of these Terms. Upon termination, your right to use the Service immediately ceases.

17

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDSTREAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

18

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FIELDSTREAM OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING MARKETPLACE INTERACTIONS OR USER CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDSTREAM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID FIELDSTREAM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

19

Indemnification

You agree to defend, indemnify, and hold harmless Fieldstream from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your marketplace listings or transactions; or (d) your violation of these Terms or any law or third-party right.

20

Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully.

Except where prohibited by law, you agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis only, and you waive any right to bring or participate in a class action, class arbitration, or representative proceeding.

You and Fieldstream agree that any court proceedings permitted under these Terms (such as to enforce an arbitration award or to seek injunctive relief) will be brought exclusively in the state or federal courts located in St. Tammany Parish, Louisiana, and you consent to that jurisdiction and venue.

21

Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law rules. Fieldstream LLC is organized under the laws of the State of Wyoming; however, venue and governing law for disputes shall be as stated herein.

22

Changes to Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other reasonable means. Your continued use after changes become effective constitutes acceptance.

23

Electronic Signature and Consent

By checking the acceptance box, creating an account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and the Privacy Policy. You agree that your electronic acceptance constitutes your electronic signature and has the same legal effect as a handwritten signature.

24

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

25

Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Fieldstream's failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

26

Force Majeure

Fieldstream shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, governmental actions, or other force majeure events.

27

No Agency; No Partnership

Nothing in these Terms creates any agency, partnership, joint venture, employment, franchise, fiduciary, or representative relationship between you and Fieldstream. You and Fieldstream are independent parties. You do not have authority to bind, act on behalf of, or represent Fieldstream in any manner. Fieldstream does not endorse, guarantee, or assume responsibility for any user, listing, communication, or transaction.

05

User Content Visibility

User Content that you post publicly may be visible to other users and may be associated with your username, profile photo, and account information. This includes posts, reels, comments, marketplace listings, trophy entries, and other public activity.

Direct messages are intended to be private between conversation participants, but they may be reviewed or disclosed if necessary for safety, moderation, legal compliance, fraud prevention, or enforcement of our Terms.

06

Third-Party Services

The Service may rely on third-party providers for hosting, authentication, storage, analytics, crash reporting, AI processing, and other operational services. These providers may process information on our behalf according to their own policies and contractual obligations.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices, content, or policies of third-party services.

07

Data Retention

We retain information for as long as necessary to provide the Service, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud or abuse, and support legitimate business purposes.

Some information may remain after deletion if retention is required or permitted by law, for safety and security reasons, for backup purposes, or where the information has been shared with other users and cannot reasonably be removed.

08

Account Deletion & Your Choices

You may update certain account and profile information within the app. You may request account deletion or data deletion by contacting Support@alloutdoors.co.

You can control certain permissions — such as camera, microphone, photos, and location access — through your iOS device settings. Disabling permissions may limit some features. You may also choose not to provide certain information, but some features may not function without it.

09

Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. However, no method of transmission, storage, or electronic processing is completely secure, and we cannot guarantee absolute security.

10

Children's Privacy

The Service is not directed to anyone under eighteen (18) years old. You must be at least 18 to use the Service. If we learn that we collected personal information from someone under 18, we may delete the information and terminate the account.

11

Marketplace Privacy & Safety

Marketplace listings may display information you choose to provide, including listing photos, descriptions, price, category, condition, general location, and seller profile information. Communications about marketplace listings may occur through direct messages.

All marketplace transactions, communications, meetings, transfers, and legal compliance are solely between users. Fieldstream does not process payments, verify buyers or sellers, escrow funds, ship items, or guarantee marketplace transactions.
12

Firearms & Regulated Items

If firearm-related or regulated item content is permitted in the Service, users are solely responsible for complying with all applicable federal, state, and local laws. Fieldstream does not verify user eligibility, licenses, legal status, background check requirements, or the legality of any transaction.

We may review, remove, restrict, or report content involving firearms, ammunition, weapons, or regulated items when required by law, platform policy, safety concerns, or our Terms.

13

AI Assistant Data

When you use the Allout AI assistant, prompts, questions, uploaded context, generated responses, and interaction history may be processed to provide responses, maintain conversation history, improve reliability, enforce safety policies, and prevent abuse.

Do not submit sensitive personal information, confidential information, or information you do not have the right to share through the AI assistant.
14

Location Data, Spots & Recovery Tracks

Precise Location

With your permission, the Service uses your device's precise location to show your position on the map, to read conditions where you are, and to operate field tools such as recovery tracking. You grant and withdraw this permission in your iOS Settings. If you decline, features that require precise location will not work, but the rest of the Service will.

Saved Spots

Coordinates you save — spots, stands, pins, and hunt or catch logs — are stored on our servers so they sync to your account and so we can generate forecasts for them. Saved spots are private to your account unless you choose to share them. Sharing a spot discloses its coordinates to whoever you share it with; treat that as permanent, because we cannot retrieve what another person has already seen or saved.

Recovery Tracks

When you use recovery tracking, the Service records a series of location points while the session is running. Recovery sessions are stored locally on your device and are not uploaded to our servers. They remain on your device until you end and clear the session or delete the App. Because they are local, they are not backed up by us, cannot be recovered by us if lost, and are not available to us to disclose.

Retention and Deletion

Location data attached to your account is retained as described in "Data Retention" and is removed when the associated content or account is deleted, subject to the exceptions noted there. You can delete individual spots and logs in the App at any time.

15

International Transfers

Your information may be processed and stored in the United States or other locations where Fieldstream or its service providers operate. By using the Service, you understand that your information may be transferred to and processed in locations outside your state, province, or country.

16

California & Other Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of certain personal information, or to object to or restrict certain processing. To make a privacy request, contact Support@alloutdoors.co.

We do not sell personal information and do not knowingly share personal information for cross-context behavioral advertising.

17

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we may notify you through the Service or by other reasonable means. Your continued use of the Service after changes become effective means you accept the updated Privacy Policy.
